First off I'm pretty sure this article is inaccurate. I've been talking to MySQL people, there is another release candidate coming out but the 5.1 release itself won't be out until June or so. So I would put a big {{citation needed}} next to claims that 5.1 final is coming out next week.
The last sentence is a bit ambiguous, but I'm pretty sure the author is confused.
Software patents are seen as a problem for open source software. Being able to restrict not only the expression of an idea, but the idea itself. Copyrights are entirely different. Open Source software is built on copyright law. The last sentence would make sense if the author meant that the Pirate Party's efforts against copyright are a threat to open source, which I suppose is possible.
I might point out that a commercial company frequently releases software well and truly before it becomes available.
Oracle 11g was released by Oracle months before it became available.
I think this is just an issue of terminology, not of error.
